Proposal JLS/2006/FPC/20 - 30-CE-00909790050

Objectives of the project

Getting to know legal systems of neighbour countries by judges applying Community law

Uniform applying Community law

Defining discrepancies and problems, creating a model of tight cooperation between the countries concerning implementing Regulations 44/2001 and 805/2004

Getting to know different kinds of judgements taken in Member States and being a base for issuing European Enforcement Order and a subject of procedure on enforcement of foreign judgements

Developing cooperation between participants and creating mutual confidence in the area of civil law

Realizing the idea of common security and justice area reveals itself inter alia through identical applying Community law in Member States. It enhances understanding and respecting law by citizens of EU. This is a task of Community judges which requires from them the knowledge of this law, ways of implementing it in other Member States and of national law in these countries. Presented programme sets itself these targets. Access to information about the law of other Member States and applying way is often insufficient despite existing Community instruments in this area such as European Judicial Network in Civil and Commercial Matters, as well as European Judicial Atlas in Civil Matters. Direct exchange of information and experiences by judges practising in 4 neighbouring Member States enables getting to know these systems and creating foundations for building the network of contacts between the judges and the courts. These contacts will allow to shorten the information flow in future significantly and to accelerate solving of problems resulting from implementing Community Law in practice.
